Abstract: El presente trabajo tiene como objetivo establecer las particularidades generales y especificas de los contratos de arrendamiento, haciendo hincapié en el arrendamiento operativo - renting, tanto desde la perspectiva de los arrendadores, como de los arrendatarios y, a su vez, analizar su normativa contable y su impacto sobre las categorías de índole financiera y fiscal que los participantes del mercado de arrendamiento desarrollan. El renting, que es un contrato de alquiler de bienes muebles, con una duración superior al año normalmente, cuya principal particularidad consiste en pactar una cuota mensual, trimestral o anual fija durante toda la vida del contrato de alquiler. Las principales características es que; son disponibles para todos, es decir, su uso no está restringido a empresas. Cualquier particular puede formalizar un contrato de renting; la empresa que alquila o sociedad de renting, suele comprar el bien seleccionado por nosotros si no lo tiene en stock, y lo pone a nuestra disposición en régimen de alquiler. En estos casos, la propiedad del bien la mantiene el arrendador, no el arrendatario como puede ocurrir en otros contratos de arrendamiento con carácter financiero; estos formatos de contrato son libres y se rigen por los pactos dispuestos en ellos, respetando siempre el Código Civil y Código de Comercio. Esto implica que las coberturas, duración o las indemnizaciones por rescisión anticipada están fijadas en las propias cláusulas del contrato; no se contempla opción de compra, por lo que se utiliza en bienes muebles que se deterioran mucho en el tiempo o su valor residual tiende a cero con el paso del tiempo; esta tipología de contratación no tiene una regulación específica ni está sujetas a normas individuales de supervisión, dado que no se considera un producto financiero como tal. Como vemos, estos tipos de contratos están fuertemente recomendados para disponer del uso de bienes muebles que no podemos comprar inicialmente por su alto desembolso o queremos tener una cobertura completa de servicios adicionales en su uso. Los contratos más extendidos de renting se llevan a cabo con los vehículos, equipos informáticos, maquinaria y mobiliario.
The objective of this paper is to establish the general and specific characteristics of the lease agreements, emphasizing the operating lease - renting, both from the perspective of the lessors, and the tenants and, in turn, analyze their accounting and its impact on the categories of financial and fiscal nature that the participants of the leasing market develop. The renting, which is a rental contract for movable property, with a duration longer than a year normally, whose main feature is to agree on a fixed monthly, quarterly or annual fee for the entire life of the rental agreement. The main features is that; they are available to everyone, that is, their use is not restricted to companies. Any individual can formalize a lease contract; the company that rents or renting company, usually buys the good selected by us if it does not have it in stock, and puts it at our disposal on a rental basis. In these cases, the ownership of the property is maintained by the lessor, not the lessee, as may occur in other leasing contracts with a financial nature; These contract formats are free and are governed by the agreements in them, always respecting the Civil Code and Commercial Code. This implies that the coverages, duration or indemnities for early termination are set in the contract clauses themselves; no purchase option is contemplated, so it is used in movables that deteriorate a lot over time or its residual value tends to zero over time; This type of contract does not have a specific regulation nor is it subject to individual supervision rules, given that it is not considered a financial product as such. As we see, these types of contracts are strongly recommended to dispose of the use of movable property that we can not buy initially because of its high outlay or we want to have a full coverage of additional services in its use. The most extended renting contracts are carried out with vehicles, computer equipment, machinery and furniture.
