Corriente de opinión de los agentes comunicadores y su influencia en la prisión preventiva, en los juzgados de investigación preparatoria del distrito judicial de San Martín, 2010 – 2017

Abstract

El presente trabajo de investigación tiene como objetivo determinar si la Corriente de opinión de los agentes comunicadores influyen en la decisión de los Jueces de investigación preparatoria del distrito judicial de San Martín en la aplicación de la Prisión Preventiva. La investigación es de tipo básico, de nivel descriptivo relacional, diseño no experimental de corte transversal; la investigación se realizó utilizando los métodos deductivo, inductivo, analítico, científico, y jurídico; tiene un enfoque mixto es cuantitativo-cualitativo; la población de estudio estuvo conformada por a los Magistrados, Abogados y los Agentes comunicadores que laboran en el Distrito Judicial de San Martín, los instrumentos que se utilizaron para recoger información fue una encuesta, para el análisis de los casos locales de Miguel Santillán y Fernando del Castillo se aplicó el método doctrinario e interpretativo y relacionados a las variables de estudio. Asimismo, los resultados muestran que, un alto porcentaje de agentes comunicadores influyen en la opinión de la sociedad generando la vulneración de los derechos fundamentales en el proceso de prisión preventiva contra el investigado. En conclusión, los agentes comunicadores al emitir juicios de opinión condenatorios anticipados contra los investigados actúan desde una postura Ético-moral; mientras que los magistrados actúan conforme a los presupuestos del Nuevo Código Procesal Penal (NCPP). Confirmándose la hipótesis que la Corriente de opinión de los agentes comunicadores influye en la decisión de los Jueces de los juzgados de investigación preparatoria del distrito judicial de San Martín en materia de prisión preventiva.

The objective of this research is determine if the current of opinion of the communicating agents influences the decision of the judges of the preparatory investigation of the judicial district of San Martín in the application of the Preventive Prison. The research is of a basic type, descriptive relational level, non-experimental cross-sectional design; the research was developed using the deductive, inductive, analytical, scientific, and legal methods; it has a mixed approach, it means is quantitative-qualitative; the simple of study was made up of magistrates, lawyers and communicating agents who work in the Judicial District of San Martín, the instruments used to collect information was a survey, for example for the analysis of the local cases of Miguel Santillán and Fernando del Castillo we applied the doctrinal and interpretative method and related to the study variables. Furthermore, the results show that a high percentage of communicating agents influence in the opinion of society, generating the violation of fundamental rights in the process of preventive detention against the investigated. In conclusion, the communicating agents when issuing anticipatory condemnatory opinion judgments against those investigated act from a moral-ethical standpoint; while the magistrates act in accordance with the legal budgets of the New Code of Criminal Procedure (NCPP). Confirming the hypothesis that the Current of opinion of the communicating agents influences the decision of the Judges of the courts of preparatory investigation of the judicial district of San Martin in the matter of preventive detention.
