La aplicación de la prisión preventiva y el principio a la debida motivación en el Segundo Juzgado de Investigación Preparatoria de Tarapoto, 2018

Abstract

La tesis titulada “La aplicación de la prisión preventiva y el principio a la debida motivación en el Segundo Juzgado de Investigación Preparatoria de Tarapoto, 2018”, analizando las características jurídicas y sociales de la aplicación de la prisión preventiva y los presupuestos, sentido y alcance del principio a la debida motivación en las resoluciones judiciales, investigación cuantitativa, con un nivel descriptivo y un diseño no experimental descriptiva simple, teniendo como muestra a 24 expedientes judiciales de prisión preventiva, y empleando la lista de cotejo como instrumento para el recojo de la información. En sus conclusiones detalla que: La aplicación de la prisión preventiva y el principio a la debida motivación en el Segundo Juzgado de Investigación Preparatoria de Tarapoto, 2018, es regular; siendo buena para las características de la prisión preventiva y deficiente para la debida motivación. Las características jurídicas y sociales de la aplicación de la prisión preventiva emitidas en las resoluciones por el Segundo Juzgado de Investigación Preparatoria de Tarapoto, 2018, son buenas, donde las característica jurídicas tienen un nivel de aplicación del 93.8% y las características sociales de 86.5%. Los presupuestos, sentido y alcance del principio a la debida motivación en las resoluciones emitidas por el Segundo Juzgado de Investigación Preparatoria de Tarapoto, 2018; tienen una valoración deficiente, con un nivel de ocurrencia de 34.5%.

In the conclusions, it is specified: The application of remand and the properly motivated principle in the Second Preparatory Investigation Court of Tarapoto, in 2018, is regular; being good for the characteristics of remand and deficient for the properly motivated principle. The legal and social characteristics of the application of remand in the court decisions issued for the Second Preparatory Investigation Court of Tarapoto, in 2018, are good, where the legal characteristics have an application level of 93.8% and the social characteristics of 86.5%. The alleged, meaning and scope of the properly motivated principle in the court decisions issued for the Second Preparatory Investigation Court of Tarapoto, in 2018; they have a poor valuation, with an occurrence level of 34.5%.
