El riesgo del derecho de propiedad sobre bienes inmuebles en el distrito de Tarapoto con la vigencia del artículo 949° del Código Civil y las nuevas exigencias registrales, período 2016

Abstract

La investigación tiene como objetivo demostrar que el derecho de propiedad sobre bienes inmuebles en la ciudad de Tarapoto viene siendo puesto en peligro debido a la posición consensualista del artículo 949° del Código Civil y las nuevas exigencias registrales. El problema que se aborda en la presente investigación tiene que ver con la pérdida de dominio sobre lo que fueron bienes propios, siendo un tema relevante en la ciudad de Tarapoto, más aún con el éxito inmobiliario y la creciente población demográfica, la misma que bordearía los 76 122 habitantes (según Censo Nacional del año 2017). Los cambios que va generando la globalización afecta a todos, pero también permite una sociedad máshorizontal que permita con mayor facilidad el acceso a la propiedad, existen muchos vacíos en la ley peruana, que permiten que las personas actúen y adquieran la propiedad de un bien solo con las facultades del tiempo de uso, lo cual genera zozobra a la población y desconfianza por el derecho a la propiedad.

The research aims to demonstrate that the right of ownership on immovable property in the city of Tarapoto is being put at risk due to consensual position in the article 949 of the Civil Code and the new registration requirements. The problem posed in this research has to do with the loss of ownership to own property, being a relevant and concerning issue in the city of Tarapoto, even more with the success of the housing companies and the growing population and demographic, the same one that would be in 76122 inhabitants (According to the National Census 2017). The changes wrought by globalization affects everyone, but also allows a more horizontal society that allows the access to the property, there are many gaps in Peruvian law, which allow people to act and acquire the property of a good only with the airtime, which creates unrest in the local population and distrust for the right of ownership to property.
