La reparación civil en sentencias condenatorias por el delito de agresiones físicas contra los integrantes del grupo familiar y la debida motivación, en el Primer Juzgado de Investigación Preparatoria de Tarapoto, 2018

Abstract

El presente trabajo denominado “La reparación civil en sentencias condenatorias por el delito de agresiones físicas contra los integrantes del grupo familiar y la debida motivación, en el Primer Juzgado de Investigación Preparatoria de Tarapoto, 2018”, tuvo como objetivo general, determinar la reparación civil en sentencias condenatorias por el delito de agresiones físicas en contra los integrantes del grupo familiar y la debida motivación, en el Primer Juzgado de Investigación Preparatoria de Tarapoto, 2018. El tipo de investigación fue de tipo básica cuantitativa, nivel descriptivo correlacional, diseño no experimental, asimismo contó con una muestra de 45 sentencias condenatorias, utilizando la técnica de recopilación documental y análisis documental. Teniendo como hipótesis general que no existe relación entre la reparación civil en sentencias condenatorias por el delito de agresiones físicas en contra de los integrantes del grupo familiar y la debida motivación en el Primer Juzgado de Investigación Preparatoria de Tarapoto, 2018; concluyendo que efectivamente no existe una relación entre la reparación civil en sentencias condenatorias por el delito de agresiones físicas en contra los integrantes del grupo familiar y la debida motivación, en el Primer Juzgado de Investigación Preparatoria de Tarapoto, 2018; teniendo un nivel de significancia mayor al 0,05 (p>0,05). La misma que permite afirmar que de haber una correcta motivación de la reparación civil, esta no generará efectos negativos en la decisión judicial y que por el contrario se evitará cuestionamientos de falta de motivación judicial y/o motivación defectuosa.

The present work entitled "Civil reparation in sentences of conviction for the crime of physical aggressions against members of the family group and the due motivation, in the First Court of Preparatory Investigation of Tarapoto, 2018", had as general objective, to determine the civil reparation in sentences of conviction for the crime of physical aggressions against members of the family group and the due motivation, in the First Court of Preparatory Investigation of Tarapoto, 2018. The type of research was basic quantitative, descriptive correlational level, non-experimental design, with a sample of 45 sentences, using the technique of documentary collection and documentary analysis. Having as a general hypothesis that there is no relationship between the civil reparation in sentences of conviction for the crime of physical aggression against members of the family group and the due motivation in the First Court of Preparatory Investigation of Tarapoto, 2018; concluding that there is indeed no relationship between the civil reparation in sentences of conviction for the crime of physical aggression against members of the family group and the due motivation, in the First Court of Preparatory Investigation of Tarapoto, 2018; having a significance level greater than 0.05 (p>0.05). The same that allows affirming that if there is a correct motivation of the civil reparation, this will not generate negative effects in the judicial decision and that on the contrary, it will avoid questions of lack of judicial motivation and/or defective motivation.
