Criterios aplicados para determinar la indemnización del cónyuge afectado en el divorcio por la causal de adulterio desarrollado en el 1er Juzgado Especializado de Familia de Tarapoto, 2020

Abstract

En la presente tesis titulada “Criterios aplicados para determinar la indemnización del cónyuge afectado en el divorcio por la causal de adulterio desarrollado en el 1er Juzgado Especializado de Familia de Tarapoto, 2020”, el objetivo general fue determinar los criterios que tiene en cuenta la magistrada del 1er Juzgado Especializado de Familia de Tarapoto para fijar la indemnización del cónyuge afectado por la separación de cuerpo por la causal de adulterio, en relación a los procesos desarrollados entre los años 2009 al 2020. En el Perú existen jurisprudencia y doctrina que hablan sobre la indemnización por adulterio, a raíz de ello, se observa si es que los jueces del juzgado utilizan esos lineamientos o criterios dados por las fuentes de nuestra legislación o si utilizan su propio criterio para expedir una sentencia. Presenta el tipo de investigación de método cuantitativo de nivel descriptivo con diseño no experimental, por cuanto se observa el fenómeno dentro del contexto natural, donde se concluye que al conocer el divorcio por la causal de adulterio respecto a los procesos desarrollados en el 1er Juzgado Especializado de Familia se tiene en cuenta aspectos como: la documentación necesaria que acredite el daño para la indemnización, reparación del cónyuge inocente, siendo la reparación más común la de daño moral, y después el lucro cesante y daño emergente.

In this thesis entitled "Criteria applied in order to determine the compensation of the spouse affected in the divorce on the basis of adultery developed in the 1st Specialized Family Court of Tarapoto, 2020", the general objective was to determine the criteria taken into account by the magistrate of the 1st Specialized Family Court of Tarapoto to determine the compensation of the spouse affected by the physical separation on the basis of adultery, in relation to the processes carried out between the years 2009 to 2020. In Peru there are jurisprudence and doctrine that refer to the compensation for adultery, consequently, it is observed if the judges of the court use those guidelines or criteria given by the sources of the legislation or if they use their own criteria to issue a sentence. The type of research presents a descriptive quantitative method with a non-experimental design, since the phenomenon is observed within the natural context. It is concluded that when considering divorce on the grounds of adultery with respect to the processes developed in the 1st Specialized Family Court, the following aspects are taken into account: the necessary documentation that proves the damage for compensation, reparation of the innocent spouse, being the most common reparation that of moral damage, and then that of consequential damage and loss of profits.
