Supervisión de las sanciones por infracciones en materia de seguridad y salud en el trabajo por SUNAFIL – San Martín, 2021

Abstract

La presente investigación determina a la SUNAFIL como un organismo por el cual el Estado peruano cumple con la obligación de respetar los derechos de los trabajadores creando condiciones suficientes para el desarrollo de las actividades económicas de una empresa para promover su formalización y productividad, tuvo como problema principal la interrogante ¿De qué manera se supervisan las sanciones por infracciones en materia de seguridad y salud en el trabajo por SUNAFIL – San Martín, 2021?; originando el objetivo general, Determinar de qué manera se supervisan las sanciones por infracciones en materia de seguridad y salud en el trabajo por SUNAFIL – San Martín, 2021, como objetivos específicos i) Analizar el nivel de Supervisión en materia de seguridad y salud en el trabajo impuestas por SUNAFIL – San Martín; ii) Identificar los tipos de infracciones en materia de seguridad y salud en el trabajo por SUNAFIL – San Martín; y iii) Analizar las resoluciones de infracción de los expedientes administrativos por infracciones en materia de seguridad y salud en el trabajo por SUNAFIL – San Martín. El ámbito de la investigación se encuentra ubicado geográficamente en el distrito de Tarapoto en la sede de la Intendencia Regional de SUNAFIL – San Martin, comprendiendo el periodo de Julio a Diciembre del 2022, la metodología empleada fue de tipo aplicada con enfoque cuantitativo, nivel descriptivo - correlacional, diseño de investigación no experimental, teniendo como instrumento, guía de encuesta y un pequeña entrevista dirigida a los trabajadores de la SUNAFIL, la guía de análisis documental a resoluciones emitidas por la entidad respecto a las infracciones cometidas por distintas entidades. Dando como resultado, un análisis detallado de los tipos de infracciones que son comúnmente cometidos por diversas empresas poniendo en peligro el bienestar de sus trabajadores y la propia productividad de estas. Concluyendo que el nivel de supervisión es alto en un 67% en materia de seguridad y salud en el trabajo impuestos por SUNAFIL-San Martin, sin embargo, aún existen determinadas falencias, si bien la supervisión es adecuada la entidad de SUNAFIL multa al empleador por infracciones específicas, así mismo, se tiene que SUNAFIL cumple con su labor de multar ante la detección de cualquier infracción cometidas por las empresas, pero no realiza una labor eficiente para comprobar si dichas infracciones fueron corregidas.

This research identifies SUNAFIL as an agency through which the Peruvian State fulfills its obligation to respect the rights of workers by creating sufficient conditions for the development of the economic activities of a company to promote its formalization and productivity. The main problem was the question How are the sanctions for occupational health and safety violations supervised by SUNAFIL - San Martín, 2021? The general objective is to determine how sanctions for occupational health and safety violations are supervised by SUNAFIL - San Martín, 2021, and the specific objectives are i) To analyze the level of supervision of occupational health and safety violations imposed by SUNAFIL - San Martín; ii) To identify the types of occupational safety and health infractions by SUNAFIL - San Martín; and iii) To analyze the resolutions of infraction of the administrative files for occupational safety and health infractions by SUNAFIL - San Martín. The scope of the research is geographically located in the district of Tarapoto at the headquarters of the Regional Intendancy of SUNAFIL - San Martin, covering the period from July to December 2022. The methodology used was applied with a quantitative approach, descriptive-correlational level, non-experimental research design, having as an instrument, a survey guide and a short interview directed to the SUNAFIL workers, the documentary analysis guide to resolutions issued by the entity regarding the infractions committed by different entities. The result shows that a detailed analysis of the types of infractions that are commonly committed by various companies endangers the well-being of their workers and their own productivity. In conclusion, the level of supervision is high at 67% in terms of occupational safety and health imposed by SUNAFIL-San Martin, however, there are still certain shortcomings, even though supervision is adequate, the SUNAFIL entity fines the employer for specific infractions, likewise, SUNAFIL complies with its task of fining upon detection of any infraction committed by the companies, but does not perform an efficient task to verify whether such infractions were corrected.
