Abstract: La tributación en negocios “en línea” nace debido al avance de tecnología y la consolidación del Internet, mediante el cual han surgido la comercialización de bienes y servicios que se los realiza utilizando este medio, pero por el tratamiento y el procedimiento que tienen, ninguna de estas transacciones genera algún tipo de tributación. En el país no existe una verdadera norma que regule las actividades comerciales realizadas a través de la web en materia tributaria. La consecuencia de estas nuevas formas de utilización de la tecnología muestra que el país en el ámbito académico, legal y social, aún no se preocupa del avance enérgico que tiene el internet y el negocio electrónico, con el fin de desarrollar normas o directrices mediante las cuales se puedan controlar las actividades comerciales de los sujetos pasivos de la tributación. La potestad que tiene el Estado en cuanto a los tributos y su forma de gravar al Comercio Electrónico es uno de los principales problemas pues no se puede exigir el cumplimiento de los mismos fuera del territorio nacional. Y actualmente no hay convenios ni tratados de fiscalidad en temas de Comercio Electrónico. El Comercio Electrónico también es un blanco fácil de utilizar como herramienta para prácticas que atentan en legalidad y ética. La utilización del internet incluso puede facilitar que las actividades comerciales sean más directas y no posean intermediarios dejando a un lado el control tributario de evasión, elusión y defraudación fiscal. El presente Informe Monográfico surge por los conceptos, visiones y metodologías innovadoras de la tecnología de la información. Esta tecnología, ha generado un efecto multiplicador en la transmisión de información en la velocidad para realizar negocios, la amplísima posibilidad para obtener información sobre los mercados físicos y de capitales, así como la reducción de la distancia entre proveedores y consumidores, son consecuencias propias de esta revolución tecnológica.
Taxation within online trading has emerged due to the advances of technology and the emerging resonant presence of the internet., through which the commercialization of goods and services that are made using this medium has arisen, but due to the treatment and the procedure they have, none of these transactions generates some type of taxation. In the country there is no real norm that regulates the commercial activities carried out through the web in tax matters. The consequence of these new ways of using technology shows that the country in the academic, legal and social field, still does not worry about the energetic advance of the Internet and electronic business, in order to develop norms or guidelines through the which can control the commercial activities of the passive subjects of taxation. The power that the State has in terms of taxes and how to tax Electronic Commerce is one of the main problems because they can not be demanded outside the national territory. And currently there are no agreements or tax treaties on issues of Electronic Commerce. Electronic Commerce is also an easy target to use as a tool for practices that violate legality and ethics. The use of the internet can even facilitate that the commercial activities are more direct and do not have intermediaries leaving aside the tax control of evasion, avoidance and tax fraud. This Monographic Report arises from the concepts, visions and innovative methodologies of information technology. This technology has generated a multiplying effect in the transmission of information on the speed to conduct business, the wide possibility to obtain information on the physical and capital markets, as well as the reduction of the distance between suppliers and consumers, are consequences of this technological revolution.
