La relación entre la aplicación del Principio de Oportunidad y el delito de Omisión a la Asistencia Familiar, en la Primera Fiscalía Provincial Penal Corporativa de Tarapoto, 2019

Abstract

La presente tesis titulada: La relación entre la aplicación del Principio de Oportunidad y el delito de Omisión a la Asistencia Familiar, en la Primera Fiscalía Provincial Penal Corporativa de Tarapoto, 2019, tiene como objetivo general el determinar cuál es la relación existente entre la aplicación del Principio de Oportunidad y el delito de Omisión a la Asistencia Familiar; asimismo como objetivos identificar la aplicación de los elementos doctrinarios y jurídicos del principio de oportunidad en el delito de Omisión a la Asistencia Familiar, así como también identificar las características de dicho delito y finalmente establecer la relación entre las dimensiones ya mencionadas, todas aplicadas en la Primera Fiscalía Provincial Penal Corporativa de Tarapoto, 2019. La presente es una investigación del tipo aplicada, nivel explicativo; diseño no experimental; donde la muestra de estudio estuvo conformada por 73 carpetas fiscales; aplicando como técnicas de recojo de información: análisis documental y como instrumento la ficha de análisis documental; siendo las variables sometidas al estudio: el Principio de Oportunidad y el delito de Omisión a la Asistencia Familiar. Finalmente los resultados muestran concluyentemente que la relación entre dichas variables, es alta y significativa; definida por el estadístico del correlacional de Pearson que asume un valor de 0.814 con un nivel de significancia de 0.01, y los resultados explican que su aplicación logra un 100% de efectividad del pago, es decir que aproximadamente 8 de cada 10 casos se cumple con el pago del adeudo de forma inmediata y total; de igual manera respecto a las características del delito de Omisión a la Asistencia Familiar, estas no son uniformes.

The present thesis entitled: The relationship between the application of the Principle of Opportunity and the crime of Omission to Family Assistance, in the First Corporate Provincial Criminal Prosecutor's Office of Tarapoto, 2019, has as general objective to determine what is the existing relationship between the application of the Principle of Opportunity and the crime of Omission to Family Assistance; Likewise, the objectives are to identify the application of the doctrinal and legal elements of the Principle of Opportunity in the crime of Omission of Family Assistance, as well as to identify the characteristics of said crime and finally to establish the relationship between the aforementioned dimensions, all applied in the First Provincial Corporate Criminal Prosecutor's Office of Tarapoto, 2019. The present is an applied research, explanatory level; non-experimental design; where the study sample consisted of 73 prosecutors' folders; applying as data collection techniques: documentary analysis and as an instrument the documentary analysis sheet; being the variables subjected to the study: the Principle of Opportunity and the crime of Omission to Family Assistance. Finally, the results show conclusively that the relationship between these variables is high and significant; defined by the Pearson correlation statistic that assumes a value of 0.814 with a significance level of 0.01, and the results explain that its application achieves 100% payment effectiveness, that is to say that approximately 8 out of 10 cases the debt is paid immediately and in full; likewise, with respect to the characteristics of the crime of Omission of Family Assistance, these are not uniform.
