El grado de afectación en los Derechos Patrimoniales en los procesos hereditarios tramitados en el Juzgado Civil de Tarapoto, 2018 -2020.

Abstract

La presente investigación titulada el grado de afectación en los Derechos Patrimoniales en los procesos hereditarios tramitados en el Juzgado Civil de Tarapoto, 2018 -2020, tuvo como objetivo general: Determinar cuál es el grado de afectación en los Derechos Patrimoniales en los procesos hereditarios tramitados en el Juzgado Civil de Tarapoto, 2018-2020, siendo sus objetivos específicos: Analizar el grado de afectación en los Derechos Patrimoniales tramitados en el Juzgado Civil de Tarapoto así como identificar los procesos hereditarios tramitados en el Juzgado Civil de Tarapoto y conocer los fundamentos de la pretensión que motivan el proceso en vía judicial en los casos de petición de herencia y/o declaración de herederos; es de tipo básica, con un enfoque cuantitativo, nivel descriptivo-correlacional. La hipótesis de la investigación fue: El grado de afectación en los Derechos Patrimoniales en los procesos hereditarios tramitados en el Juzgado Civil de Tarapoto, 2018-2020, es alta al no considerar a todos los herederos en la repartición de la masa hereditaria, teniendo como población para el desarrollo de la presente investigación a 30 personas profesionales en el campo del derecho, por lo que el muestreo fue no probabilístico y el instrumento utilizado fue el cuestionario; concluyendo con el estadístico de correlación RHO de Spearman al 0,206, y un p-valor de 0,000, menor a 0,05 con lo cual se rechaza la hipótesis nula y se afirma que existe un grado de afectación en los derechos patrimoniales y los procesos hereditarios, lo que podemos indicar que a mayor afectación en los derechos patrimoniales impactará en los proceso hereditarios tramitados en el juzgado civil de Tarapoto, 2018-2020.

The present investigation entitled "The degree of affectation of the Patrimonial Rights in the hereditary processes processed in the Civil Court of Tarapoto, 2018-2020", had as general objective: To determine what is the degree of affectation in the Patrimonial Rights in the hereditary processes processed in the Civil Court of Tarapoto, 2018-2020, being its specific objectives: To analyze the degree of affectation in the Patrimonial Rights processed in the Civil Court of Tarapoto as well as to identify the hereditary processes processed in the Civil Court of Tarapoto and to know the foundations of the pretension that motivate the process in judicial way in the cases of inheritance petition and/or declaration of heirs; it is of basic type, with a quantitative approach, descriptive-correlational level. The hypothesis of the research was: The degree of affectation in the Patrimonial Rights in the hereditary processes processed in the Civil Court of Tarapoto, 2018-2020, is high when not considering all the heirs in the distribution of the hereditary mass, having as population for the development of the present research 30 people professionals in the field of law, so the sampling was non-probabilistic and the instrument used was the questionnaire. In conclusion, with the Spearman's RHO correlation statistic at 0.206, and a p-value of 0.000, less than 0.05, the null hypothesis is rejected and it is affirmed that there is a degree of affectation in patrimonial rights and inheritance processes, which indicates that the greater the affectation in patrimonial rights, the greater the impact on the inheritance processes processed in the civil court of Tarapoto, 2018-2020.
