Calidad de las sentencias en primera instancia sobre el delito de tenencia ilegal de armas de fuego emitido por el Juzgado Penal Unipersonal Sede Tarapoto año 2015-2019

Abstract

La investigación realizada ha tenido como objetivo general: Analizar la calidad de las sentencias en primera instancia sobre el delito de tenencia ilegal de armas de fuego emitido por el Juzgado Penal Unipersonal Sede Tarapoto año 2015-2019; y como objetivos específicos: (1) Identificar las sentencias en primera instancia sobre el delito de tenencia ilegal de armas de fuego emitidas por el Juzgado Penal Unipersonal Sede Tarapoto año 2015-2019; y, (2) Determinar la calidad de la parte expositiva, considerativa, y resolutiva de las sentencias por el delito de tenencia ilegal de armas de fuego emitidos por el Juzgado Penal Unipersonal Sede Tarapoto año 2015-2019. Siendo la variable de estudio: calidad de las sentencias. El enfoque de la investigación fue el cuantitativo cualitativo, de tipo básico, con diseño no experimental, retrospectivo y nivel exploratorio descriptivo; la población y muestra consistió en 32 sentencias de primera instancia sobre el delito de tenencia ilegal de armas de fuego. Se usó como técnica el análisis documental y como instrumento la lista de cotejo; mismos que arrojaron los siguientes resultados: las sentencias en primera instancia sobre el delito de tenencia ilegal de armas de fuego que fueron emitidas por el Juzgado Penal Unipersonal Sede Tarapoto durante los años 2015 a 2019, muestran que, por una parte, las sentencias que fueron concluidas en su totalidad correspondieron a un número de 8 bajo un 25%; y por otra, que las sentencias que se encuentran en etapa de juzgamiento correspondieron a un número de 24 bajo un 75°% que conforman el total. Se evidenció la existencia de calidad alta para la parte expositiva que cumplió con los 10 parámetros analizados, calidad media para la parte considerativa al no cumplirse con los 20 parámetros analizados, y, calidad media para la parte resolutiva al no cumplirse con los 10 parámetros evaluados. Se evidenció que la calidad de sentencias en primera instancia es de 37.5% que se encuentra en calidad alta bajo la clasificación del 100% de cumplimiento del proceso, frente al 50% que se encuentra en calidad media bajo la clasificación de 60 a 80% de cumplimiento del proceso, frente al 12.5% que se encuentra en calidad baja con la clasificación de menos del 40% de cumplimiento del proceso. Se concluye que la calidad de las sentencias en primera instancia sobre el delito de tenencia ilegal de armas de fuego que fueron emitidas por el Juzgado Penal Unipersonal Sede Tarapoto durante los años 2015 a 2019 es media, ya que el valor de significación fue de 0,658 resultando mayor a 0,05 con un 95% de confiabilidad, por tanto, se confirma la hipótesis nula y se rechaza la alternativa.

The research carried out has had as a general objective: Analyze the quality of the sentences in the first instance on the crime of illegal possession of firearms issued by the Unipersonal Criminal Court Tarapoto headquarters year 2015-2019; and as specific objectives: (1) Identify the sentences in the first instance on the crime of illegal possession of firearms issued by the Unipersonal Criminal Court Tarapoto headquarters for the year 2015-2019; and, (2) Determine the quality of the explanatory, considering, and decisive part of the sentences for the crime of illegal possession of firearms issued by the Unipersonal Criminal Court Tarapoto headquarters for the year 2015-2019. Being the study variable: quality of sentences. The research approach was quantitative-qualitative, of a basic type, with a non-experimental, retrospective design and a descriptive exploratory level; The population and sample consisted of 32 first instance sentences on the crime of illegal possession of firearms. Documentary analysis was used as a technique and the checklist as an instrument; The same that produced the following results: the first instance sentences on the crime of illegal possession of firearms that were issued by the Tarapoto Unipersonal Criminal Court during the years 2015 to 2019, show that, on the one hand, the sentences that were fully completed corresponded to a number of 8 under 25%; and on the other, that the sentences that are in the trial stage corresponded to a number of 24 under 75% that make up the total. The existence of high quality was evidenced for the expository part that met the 10 parameters analyzed, medium quality for the considering part when the 20 parameters analyzed were not met, and medium quality for the operative part when the 10 parameters evaluated were not met. It was evidenced that the quality of judgments in the first instance is 37.5%, which is of high quality under the classification of 100% compliance with the process, compared to 50% that is of medium quality under the classification of 60 to 80% of compliance with the process, compared to 12.5% that is of low quality with the classification of less than 40% compliance with the process. It is concluded that the quality of the sentences in the first instance on the crime of illegal possession of firearms that were issued by the Unipersonal Criminal Court Tarapoto headquarters during the years 2015 to 2019 is medium, since the value of significance was 0.658 resulting greater than 0.05 with 95% reliability, therefore, the null hypothesis is confirmed and the alternative is rejected.
